Student Art Prints Terms of Service
1) Acceptance of Terms
1.1. Introduction: Welcome to Student Art Prints ("Company," "we," "our," or "us"). These Terms of Service ("ToS") govern your use of our platform and services ("Service") as either an artist selling art on the site ("The Artist") or a person shopping on the site ("The Customer"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these ToS.
1.2. Acceptance: By accessing or using the Service, you agree to comply with and be bound by these ToS. If you do not agree with these terms, you must not use the Service.
1.3. Binding Entity: If you are entering into this ToS on behalf of a company, business, or other legal entity, you represent that you have the authority to bind such entity and its affiliates to this ToS. If you do not have such authority, or if you do not agree with this ToS, you must not accept this ToS and may not use the Service.
2) Role of Student Art Prints
2.1. The Artist: Student Art Prints provides a platform for artists to post and sell their art. We act as a marketplace that facilitates transactions between artists and customers. We do not own or create the art listed on our platform.
2.2. The Customer: Student Art Prints allows individuals to shop for art and make purchases. We do not create or directly supply the art but provide a platform for these transactions.
3) Responsibilities of The Artist
3.1. Listing Art: The Artist is responsible for accurately listing their art on the platform, including descriptions, and providing quality images for printing
3.2. Intellectual Property: The Artist must ensure they have the necessary rights, licenses, or permissions to sell the art and must adhere to all copyright and intellectual property laws. All art uploaded to Student Art Prints must be their sole intellectual property.
4) Responsibilities of The Customer
4.1. Purchases: The Customer is responsible for understanding and agreeing to the terms of sale, including payment, shipping, and returns when making a purchase.
5) Pricing and Fees
5.1. Student Art Prints charges a marketplace fee of 15% on each sale made through our platform.
6) Limitation of Liability
6.1. Student Art Prints, its employees, officers, and affiliates are not responsible for the accuracy, quality, legality, or safety of the art or information listed on our platform. We are not liable for any direct, indirect, or consequential damages arising from the use of our Service.
7) Changes to the ToS
7.1. Student Art Prints may update these ToS from time to time. Users will be notified of any changes. Continued use of our platform after changes constitutes acceptance of the updated terms.
8) Termination
8.1. Student Art Prints reserves the right to suspend or terminate user accounts for violations of these ToS or for any other reason at our discretion.
9) Governing Law
9.1. These ToS are governed by the laws of the state of California. Any disputes will be resolved in the state or federal courts located in California.
